3.1 Offers from SKINCARE by ES do not automatically apply to repeat orders.
3.2 SKINCARE by ES cannot be held to its offer if the customer should have understood that the offer, or any part thereof, contained an obvious mistake or error.
3.3 Additions, changes and / or further agreements are only valid if agreed in writing.
Article 4. Prices / Price increase
4.1 All mentioned prices are in euros, including 21% VAT, excluding shipping costs.
4.2 After your order, you will immediately receive an e-mail confirmation with an overview of the ordered items and the total amount, including shipping costs. Payment must be made in advance. The payment options are: iDeal
4.3 SKINCARE by ES guarantees that price increases will not take place after the said price has been established, unless the price increase is the result of statutory regulations and / or provisions.
4.4 If the price increase is not the result of statutory regulations and / or provisions, the consumer has the right to cancel the distance contract on the day on which the price increase takes effect.
Article 5. About the products
5.1 Colors on the photos may differ from reality, this can happen as a result of flash light or the differences in screens.
Article 6. Delivery
6.1 If the customer refuses or fails to provide information or instructions necessary for the delivery, the items will be stored at the expense and risk of the customer.
6.2 The delivery obligation of SKINCARE by ES will be fulfilled, subject to proof to the contrary, as soon as the goods delivered by SKINCARE by ES have been offered to the customer once. For home delivery, the report of the carrier, alleging the refusal of acceptance, extends to full proof of the offer to deliver, subject to proof to the contrary.
6.3 In the event of refusal of the goods offered, the return freight and storage costs, as well as the risk of damage or loss of the refused goods, will be entirely at the expense of the customer, unless the customer has the right to cancel the purchase or replace the good on good grounds. invokes.
6.4 Discounted items, including items that have been discounted due to special discount campaigns, cannot be returned. We recommend that you insure returns because you are legally obliged to take care of the items and because you will be held responsible for all damage to the items until we have them returned.
6.5 SKINCARE by ES does its utmost to deliver the orders as soon as possible. If the delivery is delayed - either due to being out of stock or for other reasons - or if an order cannot be executed or only partially, the customer will be notified.
6.6 If SKINCARE by ES has stated a term for delivery, this is indicative. A specified delivery time is therefore never a strict deadline. However, the final delivery time will never exceed the specified delivery time by more than ten working days, unless there is force majeure. If a term is exceeded, the customer must notify SKINCARE by ES in writing or by e-mail.
6.7 In case of hidden defects, or in case of visible defects after the trial period, any complaint must be reported within 14 days. The customer must enclose a written description of the defects found. If the customer does not request repair or replacement in writing, SKINCARE by ES will decide whether the article will be replaced.
6.8 Delivery time. Within the framework of the rules of distance selling, SKINCARE by ES will execute orders expeditiously, but at least within 10 working days (unless there is force majeure). If this is not possible (because the ordered item is not in stock or no longer available), or an order cannot or only partially be executed, the consumer (client) will receive a message within 1 month after placing the order and he has in that case the right to cancel the order without costs and notice of default.
For items that the customer sends on his own initiative, the transport costs are for his account. In that case SKINCARE by ES is not liable for damage caused during transport.
SKINCARE by ES is not liable for damage suffered by the customer or a third party through the use of an article delivered by SKINCARE by ES, unless the customer demonstrates that the damage was caused by intent or gross negligence on the part of SKINCARE by ES. (In) direct costs or damage to the customer or a third party, caused by the disuse of a defective article, are not eligible for compensation, unless the customer demonstrates that the costs or damage were caused by intent or gross negligence on the part of SKINCARE by ES.
About Refunds:
Amounts already paid for items that are returned within the trial period or advance payments made by the customer, on the basis of conditions set by SKINCARE by ES, will be refunded if the sale is not concluded, minus the shipping costs incurred.
Fully or partially processed goods, damaged goods and packaged goods, of which the packaging is missing, can never be returned.
Article 7. Dissolution
7.1 Without prejudice to the rights of SKINCARE by ES based on the law, SKINCARE by ES is entitled by means of a written statement to that effect to the customer to suspend or dissolve the agreement in whole or in part with the right to compensation towards the customer if after when concluding the agreement, SKINCARE by ES becomes aware of circumstances that give SKINCARE by ES good grounds to fear that the customer will not fulfill his obligations or if SKINCARE by ES has requested security for compliance when the agreement is concluded and this security is not provided or is insufficient (despite summons) as well as in the event of bankruptcy of the customer, an own application for bankruptcy by the customer, suspension of payments, liquidation or a decision to that effect, full or partial transfer of the customer's business or seizure of any part of its assets.
7.2 If circumstances arise with regard to persons and / or materials that SKINCARE by ES uses or usually uses in the execution of the agreement, which are of such a nature that the execution of the agreement is impossible or so inconvenient and / or becomes disproportionately expensive that compliance can no longer reasonably be required, SKINCARE by ES is authorized to dissolve the agreement.
7.3 The customer has the right to dissolve the agreement with delivered goods on the basis of an order with SKINCARE by ES, without giving any reason, within a period of 7 working days, unless explicitly agreed otherwise. This period starts when the ordered items have been delivered. If the customer has not returned the delivered goods to SKINCARE by ES after this period has expired, the purchase is a fact. Before proceeding to return, the customer is obliged to report this to SKINCARE by ES within the period of 7 working days after delivery. The customer must prove that the delivered goods have been returned on time (no later than 5 working days after delivery), for example by means of proof of postal delivery. The return of the delivered goods is entirely at the expense and risk of the customer. The goods must be returned in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered or damaged in any way by the customer, the right to dissolution within the meaning of this paragraph will lapse.
Article 8. Return shipments
8.1 Return of delivered goods takes place at the expense and risk of the Consumer-Customer and / or Customer and is only permitted after written permission from SKINCARE by ES under the conditions to be set by it.
8.2 Fully or partially processed items, damaged items and packaged items, of which the packaging is missing, can never be returned.
Article 9. Force majeure
9.1 Force majeure is understood to mean, in addition to what is understood in this regard in law and jurisprudence, all circumstances over which SKINCARE by ES has no influence and which impede or make the delivery of goods impossible, including but not limited to a strike at SKINCARE by ES and / or suppliers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties.
9.2 If the period in which fulfillment of the obligation by SKINCARE by ES is not possible due to force majeure lasts longer than 4 weeks, both parties are authorized to dissolve the agreement, without there being an obligation to pay compensation in that case.
Article 10. Guarantee
10.1 SKINCARE by ES does not offer any guarantee on delivered items.
Article 11. Payment
11.1 Unless otherwise agreed, payment must be made by iDeal. Payment in installments is not possible.
11.2 In the event of bankruptcy or suspension of payment of the customer or an application for this, the claims of SKINCARE by ES and the obligations of the customer towards SKINCARE by ES are immediately due and payable.
11.3 Discounted products cannot be exchanged or returned.
Article 12. Intellectual property rights
12.1 Unless explicitly agreed otherwise in writing, the full copyrights and all other intellectual and industrial property rights with regard to the articles delivered by SKINCARE by ES, such as trademark rights, design rights, rest exclusively with SKINCARE by ES and / or its suppliers.
12.2 The parties undertake to take sufficient measures to ensure confidentiality with regard to each other's data of a confidential nature that they become aware of during the execution of the agreement.
Article 13. Disputes
13.1 The customer can send an e-mail to SKINCARE by ES for questions and / or complaints. Complaints are usually handled within 7 days. If this is not possible for any reason, the customer will be informed of the delay time.

14.1 The Website may contain references (for example by means of a hyperlink, banner or button) to the websites of third parties. SKINCARE by ES has no control over these websites. SKINCARE by ES is not responsible for the content of these websites.
